Article 3 – Purchase
We answer to your orders within the limits of the availabilities of our stock or the stock of our suppliers. At the moment of the order you will be informed about the availability of the items you intend to buy. If the products are not available, you will be informed by e-mail and requested to modify or cancel your order. Data entered by ACCESS-PHONE.NET are the proof of the order. Data entered by the payment system are the proof of the financial transaction.

Article 4 – Price
Prices of our products are intended in EURO VAT included, and shipment cost excluded (unless special promotional actions). We reserve the right to modify our prices at any time but we engage ourselves to apply the prices already confirmed at the moment of your order. In case of order from a country different than France you will act as the importer of the ordered products. Import taxes or other types of local taxes could be therefore required. Such taxes are not of our competence. They will be at your fool charge and responsibility as to the terms of declaration and payment. We suggest to take all necessary information at your local authorities.

Article 5 – Payment
Payment in full must be effected at the moment of the order. Paid amounts cannot be never considered as down payments. All orders will be payable in EURO. To pay orders you have available all payments sown in the order form: credit card (Mastercard, Visa), bank cheque, money order and bank transfer. You give guarantee to ACCESS-PHONE.NET to have to necessary authorization to use the form of payment chosen at the moment of the fulfilment of the order form.
ACCES-PHONE.NET reserves the right to suspend or cancel order or shipments in case of fail (or mistake) of payment of the due amounts. Shipment of new orders could be suspended in case of delay of payment for a previous order.
ACCESS-PHONE.NET reserves the right to ask for a photocopy of an identity document for all payment by credit card.

Article 6 – Shipments
To ship all ordered products, ACCESS-PHONE.NET has selected the mail service by using the following systems*:
Coliposte - Collissimo Suivi : sent in J+1 e J+2 with very interesting rates.
Shipment will be effected at the address indicated at the moment of the order.
Chronopost : express service for the whole European Community with delivery from 1 to 3 days (indicative average).
* excepted light prodyucts such as cell phone displays that can be shipped like a letter.
Order of shipment is given by ACCESS-PHONE.NET after the complete cash of the price of the order. This time is given as an indicative date. All possible delay will not cause in any case reimbursement, retain or cancellation of the order form the buyer. In all cases and in conformity to the Art. L 121.20.3, ordered products will be shipped within a maximum delay of 30 days from the day of the registration of the order , payment settled. If not delivered within this terms the buyer will have the right to cancel his order. Amounts paid by the buyer will be immediately sent back excluding any other possible indemnity. In case of delay of delivery in relation with the fixed date, the buyer must inform in writing (letter or e-mail) ACCCESS-PHONE.NET, this, in order to improve the quality of service, will make a research at the French Mail. A research at the French Mail can require up to 21 days. If during this period the product will be found, it will be immediately re-shipped to the buyer or the address indicated in the order form. If the product will be not found within the term of 21 days, ACCESS-PHONE.NET will provide at his own cost to a new shipment of all products ordered by the buyer. In case of payment by bank cheque, order will be treated after receipt and cash of the cheque and terms will start from this date.

Article 7 – Property reserve
Shipped goods remains our property till to the complete accomplishment of all obligations to us i.e. to the full payment of fixed price, where necessary increased of interests. This reserve of property do not exclude or modify in any way the transfer of the risk.

Article 8 – Right of withdrawing
Buyer has a period of 7 days from the date of reception of the goods to send back at his cost the ordered products in order to be reimbursed or to substitute the same goods. All products must be sent back to ACCESS-PHONE.NET in original perfect condition (packing, accessories, instructions), duly sealed. In particular, products like software, discs, DVD, CD-Rom, consol games, phone cards, must be in their original packing in order to benefit of the recess right. All products resulting uncompleted, damaged or with damaged original packing will be not substituted or reimbursed. No products can be sent back to ACCESS-PHONE.NET prior to the necessary information sent by e-mail to the following address: contact@access-phone.net. Reimbursement will be effected by ACCESS-PHONE.NET through bank transfer or bank cheque in your name.

Article 9 – After sale service
Manufacturer guarantee all sold products against material or process defects for one year from the date of shipment. In order to obtain this guarantee we suggest to keep the relevant invoice. All return of materials for guarantee must be previously agreed with ACCESS-PHONE.NET . To this aim the buyer must contact the after sale service of ACCESS-PHONE.NET to this address : contact@access-phone.net . No return will be accepted without prior authorization by ACCESS-PHONE.NET. Guarantee consists to our choice in the substitution or reparation of the products you sent us at your cost. All products resulting uncompleted, damaged and/or with damaged original packing will be not collected or substituted within the terms of the guarantee. In order to know all necessary instructions concerning our after sale service for all your problems or failures to the products, please contact us. In any case the guarantee is not covering the substitution of wearing material, wrong utilisation of the products, defects caused by tampering or unauthorized reparations, defects and their consequences related to the misuse of the original destination of the product (professional or collective).

Article 10 – Personal data protection
With the acceptation of the present general sales conditions you agree to allow us the utilisation and treatment of such data.
In conformity with the Low of January 6th 1978, you have the right to withdraw, modify and cancel the data concerning you.

Informatics files, hold in the informatics systems of the company ES in a reasonable safety , will be considered as a proof of the communication of the orders and payments happened between the parties.
The recording of orders and invoices will be done with reliable and durable supports and they could be produced as a proof.

Article 14 – Limitation of responsibility
All proposed products has been imported (or produced) in France according to the existing legislation. It is at your charge to assure the legality of the use of the products. We furthermore decline all possible responsibility in case that the shipped product is not complying with the legislation of the destination country. Total or partial impossibility to use the products because of incompatibility of material cannot be considered a responsibility of ACCESS-PHONE.NET nor generate any kind of reimbursement.

Article 15 – Applicable low
This contract is under the French low. The original language, even translated in other language is the French language.
